Khariya is a solicitor in our Actions against Police and State team.
Since joining Bindmans LLP, Khariya has worked on a number of successful cases, including Paul Gambaccini’s claim against the Commissioner of Police of the Metropolis for misuse of private information, claims for damages arising from unlawful stop and searches, and group actions following mass arrests at protests including claims pursued by protesters attending anti-fracking protests at Horse Hill in February 2016.
In 2020, Khariya was part of the legal team that successfully challenged the release of immigration detainees from removal centres in response to the Covid-19 pandemic.
She was instructed by the Coalition of Anti-Racist Educators (CARE) and the Black Educators Alliance (BEA) with others at the firm to challenge the Department of Education’s new PHSE guidance. This challenge resulted in a review of the guidance being raised by the Department of Education, and an acknowledgement of the flaws identified by CARE and BEA.
Khariya has worked on a number of inquests since joining the firm. Recently, this has included the inquest touching on the death of Chris Nota, and the inquest touching on the death of Laura Davis.
Education and career
- Khariya graduated with a Merit in Law (LLM) with a specialism in Public International Law from LSE in 2018, and with a First in LAA (LLB)
- She graduated with a Distinction in the Legal Practice Course from BPP University in 2022
- Khariya joined Bindmans as a paralegal in the Actions again Police and State team in March 2019, before becoming a trainee solicitor in March 2021. She qualified as a solicitor in March 2023
Experience and cases
Khariya assists on a wide range of cases including:
- Civil claims for compensation in relation to actions against the police and police misconduct including for assault, false imprisonment, malicious prosecution, misfeasance in public office, discrimination claims under the Equality Act 2010 and Human Right Act claims
- Police complaints
- Inquests and subsequent civil claims for compensation, representing bereaved families of those who have died following contact with the state, including deaths in prison, during police contact, community mental health setting and in a psychiatric setting
- Immigration detention cases including challenges to continued detention, to removal directions, and relating to the provision of s.95 support, and subsequent civil claims for compensation
- Group claims concerning rights to protest, including civil actions for false imprisonment, malicious prosecution and under the Human Rights Act for breaches of Article 10 and 11 ECHR in relating to freedom of expression and freedom of assembly and association arising from the arrests and prosecution of political and environmental activists
