Our founder Sir Geoffrey Bindman KC has contributed to a recent New Law Journal article titled ‘Judicial independence – a warning from America’, which looks at the implications of a written constitution when it comes to judicial independence.
In the piece, Geoffrey considers the differences between the UK Supreme Court and its US counterpart, and notes that the politicisation of the US Supreme Court should be a powerful warning against the introduction of a written constitution in the UK.
Geoffrey highlights that “British judges have on the whole avoided overt political partisanship on the bench and the selection process has retained a high level of impartiality. Yet political pressures have strengthened under recent governments. A written constitution would add another major threat to judicial independence.”
