Advising on escalation of disputes timetables and finding points of agreement when business relationships start to breakdown is the quickest route to resolution.

Helping the CEO’s of Telcos Three UK and EE Limited find points of agreement during management of the Mobile Broadband Network Limited’s Shareholders Agreement where the cost-sharing previously agreed for the roll-out of the 3G Network was being renegotiated in light of the RAN sites now being selected for EE’s 4G Network roll-out.

Advising on the Escalation of Disputes timetable in the Shareholders Agreement. Drafting correspondence between the CEOs with OFCOM’s regulatory views being taken into account to resolve disputes and avoid potential litigation has allowed Gabrielle to quickly assess and understand the pathway to repairing business relationships.

The dispute may simply need some legal advice on the current contractual position and advice on how to re-inforce the status quo, or it may need some creative thinking about how to incentivise a re-negotiation or contract change to reflect the unanticipated or difficult to foresee consequences of doing business with a key investor, supplier or customer.
