Immigration issues often arise in domestic abuse matters. We have an expert in-house immigration team who we work with closely to provide a complete holistic service on these issues.
Personal protection injunctions
There are legal mechanisms to protect those suffering from domestic abuse and we can provide you with specialist advice in respect of the process involved and the likely outcomes so that you can feel confident taking the first step to end abusive treatment.
Broadly, there are two main mechanisms used to protect individuals from abuse by members of their family, both are types of injunctions which seek to stop someone from doing something. A non-molestation order will prevent your abuser from pestering or harassing you. They can be used to stop lots of different types of behaviour even if it is not violent, for example, they can be used to stop postal or text message communications. Occupation orders go a step further and restrict the abuser’s access to the family home or some part of it and also potentially the surrounding area.
These injunctions can be applied for at the same time or you can obtain one or the other, our specialist team will advise you on what is right in your particular case. The law in this area can be quite complex but we’re ready to support you through the process so that you achieve the outcome you want and can move forward.
