As expected, on 17 June 2022, the Home Secretary ordered the extradition of Julian Assange to the US. A Home Office spokesperson stated:
In this case, the UK courts have not found that it would be oppressive, unjust or an abuse of process to extradite Mr Assange.
Nor have they found that extradition would be incompatible with his human rights, including his right to a fair trial and to freedom of expression, and that whilst in the US he will be treated appropriately, including in relation to his health.
It is now anticipated that Julian Assange will cross-appeal the grounds on which he was unsuccessful in the Magistrates’ Court. This will largely focus on the political motivation behind the charges and extradition request, and the restrictions on the right to free speech (Article 10).
It could take months for this appeal to proceed through the courts and is highly unlikely to be resolved before 2023. Julian Assange will inevitably remain detained throughout. If there is a fundamental change in circumstances amounting to a ‘supervening event’ prior to any proposed extradition, a further application to appeal could be made. This case is still very much far from over.
