Good Divorce Week 2022: what is a ‘good’ divorce?

3 mins

We are showing support for Resolution’s Good Divorce Week 2022, taking place between 28 November and 2 December.

Good Divorce Week is an annual campaign run by Resolution, a community of more than 6,500 family justice professionals. The main initiative of this year’s campaign is to raise awareness of the major delays family courts are facing, and how this impacts families experiencing divorce, financial remedy and children proceedings.

At Bindmans, our family lawyers are proud to be members of Resolution. They are committed to promoting a constructive approach to resolving family issues that considers the needs of the whole family, and prioritises the best interests of any children involved.

Good Divorce Week aims to encourage a national conversation about how parents can embrace a child-focused approach to divorce and separation. The impact of divorce can be life-changing and if not approached correctly, its effects can have a lasting impact on all those involved. Good Divorce Week hopes to make significant change by offering thought-provoking views on how divorce can better be approached.

What is a ‘good’ divorce?

The term ‘good divorce’ is perhaps an interesting concept considering the negative stigma which can commonly be attached to divorce. This campaign hopes to begin to rewrite the common narrative of divorce as the stereotypical ‘battle’ between two sides, by encouraging those engaging in proceedings to search for better ways to manage the process.

The concept of a ‘good divorce’ is clearly reflected in the updated legislation which came into effect on 6 April 2022. The Divorce, Dissolution and Separation Act 2020 has changed the landscape of divorce law for the first time in 50 years. The legislation ended the need to apportion blame for the breakdown of a marriage, which so often could lead to feelings of resentment and have a lasting negative impact, not least for any children of the family. We are hopeful that this change will lead to more constructive discussions in the commencement of any proceedings.

We understand that divorce and separation can be a stressful and emotional time for everyone involved. We believe that with the right advice, support, and guidance, it’s possible to reach a resolution upon which families can look back and have confidence that they achieved an outcome that is right for their circumstances as well as their family, and one that limited conflict whilst ensuring the process was as amicable as possible.

For those who would like to find out more about how to achieve a ‘good divorce’, a great place to start is to take a look at Resolution’s Parenting Through Separation Guide. This gives parents practical advice and support to help them navigate the divorce process with minimal impact on any children involved.
